Article 1. Definitions
In these conditions the following definitions apply:
a) Consumer: the natural person who is not acting for purposes related to his trade, business, craft or profession;
b) Entrepreneur: the natural or legal person who offers products, (access to) digital content and/or services remotely to consumers;
c) Digital content: data produced and/or supplied in digital form;
d) Right of withdrawal: the consumer's option to cancel the distance purchase within the cooling-off period;
e) Distance communication technology: means that can be used to conclude a purchase, without the consumer and entrepreneur having to be in the same room at the same time;
f) Dutch law applies to all our terms and conditions.
Article 2. Prices
a) If a change occurs in one of the price-determining factors after completing a purchase, Swiet Moffo has the right to adjust its prices accordingly;
b) The consumer is entitled to cancel the purchase if we exercise the right to increase our prices;
c) The prices offered by Swiet Moffo include VAT.
Article 3. Offers
a) Unless otherwise stated, our offers are without obligation. An offer that contains a term can nevertheless be revoked by us, even after receipt of the order, provided that this is done within three days. Email or documentation material sent with the offer is for information purposes only;
b) Swiet Moffo expressly reserves the rights to the information provided with the offer, including in any case but exclusively the copyright, trademark, trade name, model and patent rights. This material may not be reproduced or made public.
Article 4. Payments
a) Swiet Moffo's webshop only uses iDeal payments;
b) In the event of cancellation of the purchase, the amount already paid will be refunded to the same account number with the same description and reference;
c) The consumer has the obligation to immediately report inaccuracies in payment details provided or stated to the entrepreneur.
Article 5. Dissolution / right of withdrawal
a) The risk and burden of proof for the correct and timely exercise of cancellation of the purchase lies with the consumer;
b) The consumer bears the direct costs of returning the product;
c) Excluded from the right of withdrawal are: sealed products (such as jars of herbs) that are not suitable for return for reasons of hygiene and health protection and of which the seal has been broken after delivery, have a limited shelf life, or products that are quickly spoil (like fashong sausage).
Article 6. Complaints procedure
a) Complaints about products or services from Swiet Moffo must be submitted fully and clearly described to the entrepreneur within 7 days after the consumer has discovered the defects. This can be done in writing by email via Administratie@swietmoffo.nl;
b) Complaints submitted to the entrepreneur will be answered within a period of 14 days from the date of receipt. If a complaint requires a foreseeably longer processing time, the entrepreneur will respond within 14 days with an acknowledgment of receipt and an indication of when the consumer can expect a more detailed answer;
c) The consumer must give the entrepreneur at least 4 weeks to resolve the complaint by mutual agreement. After this period, a dispute arises that is subject to the dispute settlement procedure.
